Terms of service
Last updated 12 October 2026. These terms apply to the websites, apps, hosting, care plans and digital marketing Kirosconsult provides to businesses. A written quote or agreement for your project may add to them. If the two differ, the quote or agreement applies to that project.

Once-off builds
- A build has a fixed price shown in your quote. It is paid in two: 50% to start and 50% before the site goes live. Prices are in rand (ZAR).
- The price covers the pages and features described in your quote. Local includes one round of changes and Trade two. You supply the text for each page unless the quote says otherwise. Extra pages, features or rounds are quoted before we do them.
- The first year of the domain, hosting, SSL and mailboxes is included where your quote says so.
- We give you a written schedule before work starts. Dates depend on you supplying text, photos and feedback on time.
Care plans and hosting
After the first year, hosting and care run month to month and can be cancelled on 30 days' notice. A care plan includes hosting, SSL, backups, updates and a monthly allowance of edits, as shown on the pricing page. Unused edit time does not roll over. Hosting-only (no edits) is available. If you leave, we export your site and help you move it. There is no exit fee.
Digital marketing
Marketing retainers are month to month. Ad spend is paid by you directly to the ad platform and is never marked up. We do not promise followers, rankings or sales; we provide the plan, the work and a monthly report as described for your tier.
Ownership and intellectual property
- Once your build is paid for in full you own the finished website, its design and its content. Your domain is always registered in your name, and your text, logos and photos are always yours.
- We keep ownership of our own tools, templates, libraries and know-how that we use across clients, and grant you a licence to use them as part of your site for as long as you use it.
- You promise that what you give us (text, images, logos) does not infringe anyone else's rights, and you allow us to use it to build and run your site.
- We may show the finished work in our portfolio unless you ask us not to.
Cancellation
You can cancel a once-off build at any time before launch. The 50% paid to start covers the work done up to that point and is not refunded. If the work done is worth more than that, we invoice the difference at our hourly rate. Care plans: 30 days' notice. Monthly plan: see above.
Payment
We accept EFT against your invoice, and online through Stitch (card or instant bank payment) once it is available. Invoices are due on receipt unless stated otherwise. Late amounts may pause the work or the service after reasonable notice.
Your responsibilities
Keep your login details safe, give us accurate information and feedback in good time, and do not use your site for anything unlawful. Content you publish through your site is your responsibility.
Liability
We will do the work with reasonable skill and care. We are not liable for indirect or consequential loss, or for loss of profit, data or business, to the extent the law allows. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
Third parties
Some parts of the service depend on others (domain registries, hosting, email, payment providers, ad platforms, app stores). We are not responsible for their outages or changes, but we will help you work around them.
Changes to these terms
We may update these terms. The version on this page on the date you order applies to that order.
Governing law
These terms are governed by the laws of the Republic of South Africa, and the courts of KwaZulu-Natal (Durban) have jurisdiction.
